Maintenance and alimony disputes are not just about money; they are about dignity and survival. Whether you are a wife seeking your rightful claim or a husband contesting an unfair demand, you need a strategy that works in Delhi's Family Courts.
We have a proven track record of securing favorable interim maintenance orders within the first few hearings, ensuring you have financial support while the case proceeds.
We are fully updated with the Bharatiya Nagarik Suraksha Sanhita (BNSS) and recent Supreme Court judgments regarding "Income Affidavits" which are critical in Delhi courts.
Unlike general lawyers, we dig deep into bank statements, ITRs, and credit card bills to prove (or disprove) hidden income, ensuring the maintenance amount is fair.
We file the petition under Section 144 BNSS (formerly Sec 125 CrPC) or Section 24 HMA. The court issues a notice to the spouse immediately.
Both parties MUST file a detailed "Affidavit of Assets and Liabilities" (mandatory in Delhi). This is the most critical document that decides the amount.
Based on the affidavits, the judge passes an "Interim Order" ensuring monthly payments begin immediately while the trial continues.
Cross-examination is conducted to prove actual income. The court then passes a final order for permanent alimony or monthly maintenance.
To build a watertight case in Delhi Family Courts, preparation is key. We assist you in gathering and organizing these documents to prove your financial standing and needs.

At Bhatla Law Firm, we believe in complete transparency. We do not believe in hidden costs or last-minute surprises.
We offer both per-hearing fees and lump-sum packages depending on your convenience.

Get a Fee QuoteCase at Saket Court: Secured high interim maintenance for a housewife with two children within 5 months of filing, proving the husband's hidden business income.
Case at Dwarka Court: Successfully defended a husband by proving the wife was professionally qualified and gainfully employed, reducing the claim significantly.
Case at Patiala House: Negotiated a mutual consent divorce with a fair one-time alimony payment, closing all litigation within 6 months.
Maintenance is typically a monthly amount paid during the separation or divorce proceedings (Interim) and after (Permanent) to support the wife's daily expenses. Alimony usually refers to a one-time lump sum payment made at the time of final divorce settlement to end all future financial claims.
There is no fixed formula, but the Supreme Court (in Kulbhushan Kumar vs. Raj Kumari) laid down the "25% Rule" as a guideline. Generally, courts award 20% to 25% of the husband's net disposable income to the wife. However, this depends on liabilities, standard of living, and the wife's own income.
Not entirely. Even if the wife is earning, if her income is not sufficient to maintain the same standard of living as the matrimonial home, the husband may still have to pay the difference. However, the amount will be lower compared to a non-working wife.
Under Section 144 BNSS (old 125(3) CrPC), if a husband willfully neglects to pay despite a court order, the court can issue a distress warrant, attach his property, or even order civil imprisonment (jail) for up to one month for every month of default.
Yes. Under Section 125(4) CrPC (now BNSS provisions), if it is proven that the wife is "living in adultery," she is not entitled to receive maintenance from her husband. However, strict proof is required by the courts.
